Introduction to Brownfield All Appropriate Inquiries

The brownfield amendments to CERCLA and the recent Brownfields Utilization, Investment and Local Development (BUILD) Act provide liability protections for certain landowners and potential property owners who did not cause or contribute to contamination at the property. This webinar offers an introduction or refresher on All Appropriate Inquiry (AAI), the process of evaluating a property's environmental conditions and assessing potential liability for any contamination.

Kevin Palaia is a licensed Professional Geologist with over 25 years of experience on site assessment, remediation, and sustainable revitalization programs at Brownfields, Superfund, and state waste sites. He has supported EPA’s Office of Brownfields and Land Revitalization (OBLR) for nearly 20 years across a wide range of activities. He manages direct technical assistance to brownfield communities; delivers comprehensive training on topics related to All Appropriate Inquiries (AAI), CERCLA liability, Phase & Phase II ESAs, and risk-based remedial actions; and supports EPA’s RE-Powering America’s Land Initiative in encouraging renewable energy development on contaminated lands. He has helped hundreds of communities assess and clean up contamination, develop site reuse visions, understand market economics, and implement actionable strategies for sustainable reuse. He has also managed large CERCLA site cleanup programs and led Phase I /II environmental site assessments in support of property transactions across the U.S., Canada, South America, and United Kingdom. He holds an M.S. in Hydrology (University of New Hampshire) and a B.S. in Environmental Geology (Northeastern University).

Ms. Overmeyer oversaw the implementation of EPA’s regulations governing required standards and practices for conducting environmental site assessments or “All Appropriate Inquiries,” under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). She served as EPA’s Designated Federal Official for the Agency’s Federal Advisory Committee that was tasked with developing the All Appropriate Inquiries regulation. Prior to her tenure with the Brownfields Program, Ms. Overmeyer worked in U.S. EPA’s Hazardous Waste Identification Division where she was responsible for the development of regulations under the Resource Conservation and Recovery Act.

Ms Balent is on the staff of the EPA's Technology Innovation and Field Services Division where she has worked to collect and disseminate hazardous waste remediation and characterization information since 2003. Ms Balent manages the Clean Up Information Network website and actively supports online communication and collaboration resources available to EPA. She formerly worked with the US Army Corps of Engineers Environmental Engineering Division in the Buffalo District. Ms Balent was also a member of the SUNY-Buffalo Groundwater Research Group where she constructed and tested large scale models of groundwater flow. Ms Balent has also conducted research relating to the Great Lakes, environmental remediation, and brownfields re-development. She holds a Bachelor's degree in environmental engineering from SUNY-Buffalo and a Master's degree in Information Technology from AIU.
